These Terms govern your use of PayWicket. Please read the risk and settlement terms below carefully — cryptocurrency payments work differently from traditional card payments, and by using PayWicket you accept these terms.
1. Nature of the service; non‑custodial
PayWicket ("Company," "we," "us") provides technology that facilitates cryptocurrency payments between buyers and sellers. We are a non‑custodial technology provider. We do not take custody of, hold, control, or have access to your funds or private keys at any time. Value settles directly on public blockchain networks to wallet addresses controlled by the applicable party.
2. Card payments are processed by licensed third parties
Any purchase of cryptocurrency using a credit card, debit card, or other fiat payment method is performed by one or more independent, licensed third‑party payment/on‑ramp providers (each a "Licensed Provider"). The Licensed Provider is the merchant of record for that fiat transaction. Your use of a Licensed Provider is subject to that provider's own terms, privacy policy, identity‑verification (KYC), and eligibility requirements. PayWicket does not process, store, or have access to your card details, and is not a party to, or responsible for, the fiat‑to‑cryptocurrency conversion performed by the Licensed Provider.
3. Finality and irreversibility of cryptocurrency transactions
You acknowledge and agree that cryptocurrency transactions are final, irreversible, and cannot be cancelled, reversed, refunded, or "charged back" once broadcast to and confirmed by the applicable blockchain network. After fiat value has been converted to cryptocurrency by a Licensed Provider, the reversibility protections associated with card networks no longer apply. You bear full responsibility and risk for cryptocurrency held in, or sent from, any wallet, including for errors, fraud, loss of keys, or transfers to incorrect addresses.
4. Refunds, returns, and disputes
Because on‑chain settlement is final, PayWicket does not and cannot force‑reverse a completed payment. Any refund or return is a voluntary, merchant‑initiated transfer of cryptocurrency back to the buyer, at the seller's discretion and subject to the seller's own policies. Disputes regarding goods or services are strictly between the buyer and the seller. Chargebacks arising on the card leg are handled by, and are the responsibility of, the applicable Licensed Provider — not PayWicket or the seller.
5. Assumption of risk
Cryptocurrency involves significant risks, including price volatility, network and technology risk, regulatory change, and irreversible loss. You use the Platform at your own risk and assume full responsibility for those risks.
6. Limitation of liability
To the maximum extent permitted by law, PayWicket, its affiliates, and its service providers shall not be liable for any loss arising from: (a) the acts, omissions, verification decisions, or availability of any Licensed Provider; (b) the finality or irreversibility of any blockchain transaction; (c) loss, theft, or compromise of your wallet, keys, or credentials; (d) chargebacks, reversals, or fraud occurring on the card/fiat leg; or (e) price fluctuation of any cryptocurrency.
7. Identity verification and limits
Fiat‑to‑crypto conversion may require identity verification by the Licensed Provider. PayWicket may additionally perform verification on sellers/merchants and on its own account holders as required by applicable law and its compliance program. Transactions may be subject to limits (including per‑transaction caps) for risk and compliance purposes.
8. Changes to these Terms
We may update these Terms from time to time. The effective date above reflects the most recent version. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
